The Orthopedic Expert Adheres to Standards of Professionalism
It is important that an orthopedic expert witness be a member of professional societies, be aware of the standards of professionalism, and ethical expectations. The American Academy of Orthopedic Surgeons has established guidelines for the conduct of an orthopedic expert witness. This includes expectations of ethical testimony and adherence to published scientific data in expressing opinions in the courtroom. Dr. Rosen not only adheres to these guidelines but also participated in deliberations to establish these standards in his capacity as a member of the board of councilors of the AAOS. Fellows of the American Academy of Orthopedic Surgery have been sanctioned for false or prejudicial testimony.
The Orthopedic Expert is Impartial and Honest in Evaluating a Case Before Acceptance
Impartiality and honesty are perhaps the greatest assets that an expert witness can demonstrate. There are some orthopedic expert witnesses that have shown a pattern of only offering defense or plaintiff opinions. Yet others have forsaken their clinical practice for providing testimony for hire exclusively. Dr. Rosen has a record of impartiality and maintains an active clinical practice. His goal in representing himself as an orthopedic expert witness has and will always be to give fair and impartial observations on the evidence before agreeing to be an expert witness. Telephonic consultation before review of records is not only available but also highly recommended before incurring any expense for his services.
